Who Controls US Food Imports?

5 Non-Negotiable FDA Requirements

📝

① FDA Facility Registration

Every foreign processing plant must register with FDA — free, online, renewed every 2 years. Lapsed = shipment refused.

② Prior Notice

Notify FDA before cargo arrives. Sea = 8 hrs min. Air = 4 hrs. No notice = container held at port.

③ FSVP — Foreign Supplier Verification

YOU (the US importer) are legally responsible for verifying your Indian supplier meets US food safety standards. Written hazard analysis + records required.

④ Food Safety Plan (PCHF)

Supplier must have documented hazard analysis, preventive controls & monitoring records under 21 CFR Part 117.

⑤ Import Alert / DWPE — The “Red List”

FDA keeps a public list of suppliers whose shipments are automatically detained on arrival. Most critical alerts for Indian spices:

Mandatory for retort pouches, canned curries, shelf-stable meals. Must file process with FDA if LACF applies.

9 Allergens — MUST Declare

Milk · Eggs · Fish · Shellfish · Tree Nuts · Peanuts · Wheat · Soybeans · Sesame (added 2023). Missing sesame = #1 recall trigger.

6 Mistakes That Get Shipments Rejected

🚫 Using EU Lab Reports

EU MRLs ≠ US EPA tolerances. A clean EU COA does NOT clear US customs.

🚫 Lapsed FDA Registration

Supplier registration expires every 2 years. Lapsed = automatic refusal.

🚫 Wrong Label Format

Indian / EU nutrition panel on pack = grounds for import refusal at port.

🚫 Missing Sesame Declaration

Sesame is mandatory since Jan 2023. Most recalled RTE spice products miss this.

🚫 No FSVP Records

FDA can audit you. No written hazard analysis = 483 observation & import halt.

🚫 Supplier on Import Alert

Not checking FDA’s DWPE list before contracting. One bad supplier = every shipment detained.
